KingsHost ("KingsHost," "we," "us," or "our") respects the intellectual property rights of others and expects our customers and users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), 17 U.S.C. § 512, this Policy describes the procedure for submitting notices of claimed copyright infringement and counter-notices regarding content hosted on our infrastructure.
1. Designated Copyright Agent
To submit a DMCA notice, contact our Designated Copyright Agent:
- Email: support@kingshost.net (subject line: "DMCA Notice")
- Postal address: Provided on request to verified rights holders to prevent abuse.
We may also be reachable via the U.S. Copyright Office's DMCA Designated Agent Directory. Notices submitted to other addresses or by other means may be delayed or disregarded.
2. Filing a DMCA Takedown Notice
If you believe in good faith that material accessible via our infrastructure infringes a copyright you own or are authorized to enforce, please send our Designated Copyright Agent a written notice that includes all of the following, as required by 17 U.S.C. § 512(c)(3):
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list);
- Identification of the material claimed to be infringing, with sufficient detail (URLs, screenshots, timestamps) to enable us to locate it;
- Your name, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
Misrepresentations are punishable under 17 U.S.C. § 512(f). Knowingly materially misrepresenting that material is infringing can subject you to liability for damages, including costs and attorneys' fees.
3. Our Response
Upon receipt of a complete notice, we will:
- Promptly remove or disable access to the allegedly infringing material;
- Take reasonable steps to notify the affected customer of the takedown and provide them with a copy of the notice;
- Document the takedown in our records.
4. Counter-Notification
If you are a customer whose content has been removed and you believe in good faith that it was removed as a result of mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent that includes:
- Your physical or electronic signature;
- Identification of the material that was removed and the location at which it appeared before removal;
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification;
- Your name, mailing address, and telephone number;
- A statement that you consent to the jurisdiction of the U.S. federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which KingsHost may be found), and that you will accept service of process from the person who provided the original notification or an agent of such person.
If we receive a valid counter-notification, we will forward a copy to the original complainant. If the complainant does not file an action seeking a court order against the customer within ten (10) business days of our forwarding the counter-notification, we may restore the removed material in 10 to 14 business days, in our discretion.
5. Repeat-Infringer Policy
In accordance with 17 U.S.C. § 512(i), it is our policy to terminate, in appropriate circumstances, the accounts of customers who are repeat infringers of copyright. We track substantiated DMCA notices on a per-account basis. Customers who accumulate multiple substantiated notices, or who are subject to a single notice of egregious infringement (such as widespread distribution of pirated content), are subject to suspension and termination without refund.
6. International Notices
While the DMCA is United States law, we accept comparable copyright takedown notices from rights holders in other jurisdictions. Notices that follow the substantive elements above and identify the work, the infringing material, and the legal basis for the claim will be processed under the same workflow.
7. Modifications
We may update this DMCA Policy from time to time. The "Last updated" date at the top reflects the most recent revision.
